1. Agreement to Terms

By accessing or using the services provided by Ganguly Consulting ("Company," "we," "our," or "us"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

2. Services Description

Ganguly Consulting provides business growth and automation consulting services, including but not limited to:

  • CRM setup and implementation (Zoho, HubSpot, etc.)
  • Marketing automation and email campaigns
  • Website and landing page development
  • SEO and content marketing services
  • Paid advertising management (Meta, Google Ads)
  • Business strategy consulting
  • PR and magazine placements

3. Service Plans and Pricing

We offer two all-inclusive monthly service tiers published on our website: Growth Accelerator at $3,000 per month and Global Scale Engine at $5,000 per month. Each tier bundles the growth and automation services described on our Pricing page. Scope, priorities, and any additional work may be further defined in a written statement of work or client agreement.

4. Case Studies and Client Confidentiality

Use of Pseudonyms: All client names, company names, and identifying details used in our case studies, testimonials, and marketing materials are pseudonyms (fictional names) used to protect our clients' business information.

This practice is in accordance with the Non-Disclosure Agreements (NDAs) we sign with every client. While the results, strategies, and outcomes described in our case studies are based on real client engagements, we use dummy names to maintain strict confidentiality.

We do not disclose actual client identities without explicit written consent from the client, regardless of the nature of the inquiry.

5. Client Data Protection

We are committed to protecting our clients' confidential information and business data. As a matter of policy:

  • We do not share, sell, or disclose client business information, strategies, or data to any third parties
  • We do not disclose client information to legal authorities without the client's explicit consent, except where required by valid legal process with proper client notification
  • All client data is stored securely and handled in accordance with industry best practices
  • Our team members are bound by confidentiality agreements
  • Upon termination of services, client data is retained only as necessary for legal compliance and is securely deleted upon request

6. Payment Terms

  • All payments are processed through Razorpay or other approved payment processors
  • Monthly subscriptions are billed at the start of each billing cycle
  • Prepaid, multi-month, or other billing schedules apply only when agreed in writing
  • All fees are non-refundable unless otherwise stated
  • We reserve the right to suspend services for non-payment

7. Client Responsibilities

As a client, you agree to:

  • Provide accurate and complete information
  • Grant necessary access to platforms and accounts
  • Respond to requests and approvals in a timely manner
  • Comply with all applicable laws and regulations
  • Not use our services for any illegal or unauthorized purpose

8. Intellectual Property

Our Property: All materials, methodologies, tools, and frameworks developed by Ganguly Consulting remain our intellectual property.

Your Content: You retain ownership of all content you provide. You grant us a license to use this content to deliver our services. Deliverables created specifically for you become your property upon full payment.

9. Confidentiality

Both parties agree to keep confidential any proprietary information shared during the course of our engagement. This includes business strategies, financial data, customer information, and technical systems. This obligation survives termination of our agreement.

10. Termination

  • Initial commitment period is 3 months for both published service tiers
  • After the initial period, either tier may be cancelled with 30 days notice
  • Custom or prepaid engagements renew or end as specified in your signed agreement
  • We may terminate for breach of these terms or non-payment
  • Upon termination, we will provide reasonable transition assistance

11. Limitation of Liability

While we strive for excellence (we are ISO 9001:2015 certified), we cannot guarantee specific business results. Our services are provided "as is" without warranty of merchantability or fitness for a particular purpose.

Our liability is limited to the fees paid for services in the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential damages.

12. Dispute Resolution

Any disputes will first be attempted to be resolved through good-faith negotiation. If unresolved, disputes will be settled through binding arbitration in accordance with applicable laws. The prevailing party may recover reasonable legal fees.

13. Modifications

We reserve the right to modify these Terms at any time. We will provide notice of material changes via email or website notification. Continued use of our services after changes constitutes acceptance of the modified terms.
